These conditions regulate and are applicable to all sales made by NCH Stock 23 SL (hereinafter ncharchery.com), from its website accessible through the URL www.ncharchery.com

Placing any order implies that you have read and accepted these conditions of sale. If you wish, you can print a copy of this document, in order to facilitate future references as well as your knowledge.

IMPORTANT WARNING

NCH Archery is in the process of launching it's new website. Due to this circumstance the website may present errors both in price and stock. All the purchases must be manually verified and confirmed by NCH Archery personal before it can be accepted and we can start to process it. The customer acknowledges this circumstance and he agrees to it when sending his order.

In cases like that NCH Archery will reimburse the customer as soon as possible.

PRODUCTS

The products marketed by ncharchery.com include the name, the price including VAT, in many cases a detailed technical sheet and generally one or more descriptive photographs.

The products marketed by ncharchery.com are not valid to be used in illicit or fraudulent activities, and should not be used for commercial purposes without the relevant authorizations and permissions.

ncharchery.com is not responsible, in any case, for the use that users give to the products.

For residents in Spain, the Crossbows need a TYPE E weapons permit. All the necessary documentation must be provided to send it to the international supplier, who will in turn send the crossbow to Intervención de Armas de la Guardia Civil closest to customer’s address, where you’ll have to pick it up. Note that there are some added costs in transport since the product travels directly from the international provider to customer’s destination.

PRICES

All the prices in ncharchery.com are expressed in Euros and include VAT.

Due to the fluctuations of currency in the international market, the prices of the articles, except for errors, may vary at any time and without prior notice to the customer. In this case, the customer is free to continue with the order or cancel it. If the item is in stock we can maintain its old price, but if we have to request it (international) we will have to adjust to the new price set by the manufacturer.

Customers, whether they are individuals and companies located in the Peninsula and the Balearic Islands, are subject to the application of the current VAT. Customers from the Canary Islands, Ceuta and Melilla are excluded from paying VAT. Customers from countries other than Spain but within the European Economic Community are required to pay the VAT in force at that time in Spain. Except for companies with an intra-community VAT number, which are exempt from paying VAT, and must declare that purchase in their country according to their current VAT. Customers from the rest of the world are exempt from paying VAT. The system will verify in each order the VAT number of the client with the European VIES database, to apply the VAT exemptions corresponding to intra-community sales.

SHIPPING COSTS

Shipping costs will always be borne by the customer and are included in the total price of the order. All shipments will be made by courier, always choosing the most advantageous for the customer based on the volume and weight of the packages, as well as the final destination.

Shipments to the Canary Islands, shipping costs "always" are postage due as well as any type of IGIC taxes or other derived expenses. The client can opt for any other transport company indicating it previously.

PURCHASING PROCESS

In order to buy at ncharchery.com, the customer only has to choose the product or products they wish to purchase and add them to the shopping cart that appears next to the tab for each of the products.

WARRANTY

In the event that the customer detects an anomaly or malfunction of the product, provided that there is no manipulation by the customer, the customer may choose to repair the good or its replacement, unless one of these options is impossible or disproportionate for www.ncharchery.com. Once the customer informs ncharchery.com of his choice, both parties must abide by it.

The warranty return does not cover the transport costs in the return of the product as well as in subsequent shipment in the case of repair or change, always being the customer’s responsibility, and not admitting any product that does not come in these conditions.

The warranty period will not apply in the event of faults or defects caused by accident, negligence or misuse of the product by the customer. In the same way, the manipulation or variation of any product (soldering, wiring, adding components, etc.) will automatically cancel the guarantee.

GENERAL CONTRACT CONDITIONS

This contractual document will govern the contracting of products and services through the web: ncharchery.com, property of NCH STOCK 23 SL, hereinafter PROVIDER.

The acceptance of this document implies that the USER/CLIENT:

- You've read, you understand and you agree with this text.

- Is a person with sufficient capacity to contract.

-He assumes all the obligations set forth herein.

The PROVIDER informs that the business is responsible and knows the current legislation of the countries to which it sends the products and reserves the right to unilaterally modify the conditions, without this affecting the goods or promotions that were acquired prior to the modification.

IDENTITY OF CONTRACTING PARTIES

OBJECT OF CONTRACT

The purpose of this contract is to regulate the contractual relationship of sale originated between the PROVIDER and the USER at the moment in which the latter accepts the corresponding box during the online contracting process.

The contractual relationship of sale entails the delivery, in exchange for a certain price publicly exposed through the website, of a specific product or service.

Due to the fluctuations of currency in the international markets, the prices of the articles, except for errors, may vary at any time and without prior notice to the client. The customer may choose to continue with the order or cancel it. If the item is in stock we can maintain its old price, but if we need to order it (international) we will have to adjust to the new price set by the manufacturer.

CONTRACTING PROCESS

The USER, in order to access the services or products offered by the PROVIDER, must register through the website by creating a user account. Therefore, the USER must freely and voluntarily provide the personal data that will be required, which will be treated in accordance with the provisions of Regulation (EU) 2016/679 of April 27, 2016 (GDPR) regarding the protection of natural persons with regard to the processing of personal data and the free circulation of these data and detailed in the Legal Notice and Privacy Policy of this website.

The USER will select a username and a password, committing to make diligent use of them and not to make them available to third parties, as well as to notify the PROVIDER of the loss or theft of the same or possible access by an unauthorized third party , so that it proceeds to the immediate blocking.

Once the user account has been created, it is reported that in accordance with the requirements of article 27 of Law 34/2002, on Services of the Information Society and Electronic Commerce (LSSICE), the contracting procedure will continue the following steps:

Unless specifically stipulated in writing, placing an order with the PROVIDER will imply acceptance by the USER of these legal conditions. No stipulation made by the USER may differ from those of the PROVIDER if it has not been expressly accepted in advance and in writing by the PROVIDER.

SHIPPING

The PROVIDER will not send any order until it has verified that the payment is done.

Shipments will usually be made by EXPRESS COURIER, according to the destination freely designated by the USER.

The delivery time will be indicated at the time of purchase whenever possible. Special order and out-of-stock may vary and will be personally informed by email.

The dates or delivery times will be understood as approximate, and the delay will not constitute an essential breach of contract. In the event that the PROVIDER has not delivered the merchandise after 30 days from the agreed delivery date, the customer will be entitled to cancel the order and receive a refund of the total amount paid at no cost, and without derive no liability for damages attributable to the PROVIDER, except for those cases of special international or personalized orders that suppose an exceptionality and provided that the USER has been informed of that situation and has accepted the delay in delivery.

The PROVIDER will not assume any responsibility when the delivery of the product or service does not take place because the data provided by the USER is false, inaccurate or incomplete.

The delivery will be considered delivered at the moment in which the carrier has made the products available to the USER.

It is up to the USER to verify the products upon receipt and expose all reservations and claims that may be justified in the delivery receipt document.

The PROVIDER will not be responsible for delivery delays associated with the carrier. However, the PROVIDER will check that the delivery has been made by the carrier and will help the USER as much as possible if there are delays or incidents related to the carrier.

RIGHT OF WITHDRAWAL

The USER has a period of fourteen calendar days, counted from the date of receipt to returning date (article 71 of Law 3/2014 of March 27th). Unless the return is made due to defects in the product, the expenses related to the shipment will be assumed by the USER. The product must be returned in its original packaging and in perfect condition.

The right of withdrawal may not be applied in the following cases:

If the product is not returned in perfect condition.

If the product packaging is not the original or is not in perfect condition. The original packaging must protect the product so that it is received in perfect condition, the use of seals and adhesive tapes applied directly on it being prohibited.

When the product is open without being able to prove that it has not been used.

When they are sold-out products at the distributor, personalized products or products out of catalog and the customer has been informed, or those that, for reasons of hygiene or other legally provided exceptions, are not subject to this right.

All returns must be communicated to the PROVIDER, through the form enabled for this in your USER account, or by email to info@ncharchery.com indicating the invoice or order number.

Once the USER has received confirmation of his request, he will send the product to the PROVIDER, with the transport costs at his own expense, to the address NCH STOCK 23 SL Calle Castillo de Capua 10 nave 23, 50197 Zaragoza

Once the returned items have been received, and verified that all established requirements are met, the PROVIDER will reimburse the amount to be USER.

FORCE MAJEUR

The parties will not incur liability for any fault due to force majeure. The fulfillment of the obligation will be delayed until the cessation of the case of force majeure.

COMPETENCE

The USER may not assign, transfer or transmit the rights, responsibilities and obligations contracted in the sale.

If any stipulation of these conditions is considered null or impossible to comply with, the validity, legality and compliance of the rest will not be affected in any way, nor will they be modified in any way.

The USER declares to have read, know and accept these General Conditions in their entirety.

GENERALITIES OF THE OFFER

All sales and deliveries made by the PROVIDER shall be understood to be subject to these General Conditions.

No modification, alteration or agreement contrary to the Commercial Proposal of NCH STOCK 23 S.L. or stipulated here will take effect, unless expressly agreed in writing signed by the PROVIDER, in this case, these particular agreements will prevail.

Given the continuous technical advances and improvements of the products, the PROVIDER reserves the right to modify its specifications regarding the information provided in its advertising, until it affects the value of the products offered. These modifications will also be valid in the event that, for any reason, the possibility of supplying the products offered is affected.

PRICE AND OFFER VALIDITY PERIOD

The prices indicated on the website for each product include Value Added Tax (VAT) or other taxes that may be applicable. These prices, unless expressly stated otherwise, do not include shipping, handling, packaging, shipping insurance or any other additional services and annexes to the product or service purchased.

The prices applicable to each product are those published on the website and will be expressed in EURO currency. The USER assumes that the economic valuation of some of the products may vary in real time.

Before making the purchase, you can check all the details of the budget online: items, quantities, price, availability, transport costs, charges, discounts, taxes and the total purchase. Prices may change daily while the order is not placed.

Any payment made to the PROVIDER entails the issuance of an invoice in the name of the registered USER or the company name that the latter has informed at the time of placing the order. This invoice will be sent together with the purchased product to the email address provided by the USER.

SHIPPING COST

At the time of closing an order, the website will specify the shipping costs on your invoice, unless expressly agreed otherwise.

For shipments to the Peninsula or the Balearic Islands, the postage will be calculated at the time of placing your order.

For shipments to the Canary Islands, postage and other customs expenses associated with the shipment, the USER will have to pay them later to the carrier, once the package is received at destination.

For international shipments, consult personally.

Certain shipments with large volume packages may require their quotation and subsequent acceptance by the customer.

PURCHASING PROCESS

Cart (budget simulation)

Any product from our catalog can be added to the cart. In this, only the name of the item, the quantity, the price and the total amount will be observed. Once the Cart is saved, the taxes, charges and discounts will be calculated according to the payment and shipping data entered.

The Cart does not have any administrative link, it is only a section where you can simulate a budget without any commitment on both sides.

From the basket you can make an order following the following steps for its correct formalization:

Verification of billing information.

Verification of the shipping address.

Selection of the form of payment.

Place the order (buy).

Once the order is processed, the system instantly sends an email to the PROVIDER's management department.

Orders (purchase requests)

In a maximum of 24 hours, on working days, an email will be sent confirming the status of the order and the date of shipment.

APPLICABLE WARRANTY

In accordance with RDL 7/2021, our products purchased from January 1st, 2022, have the legally established guarantee of 3 years. Products purchased previously have a 2-year warranty.

Some products subject to wear such as strings, cables, nocks, feathers, pins, rubbers, silencers, torques, etc. They do not have a guarantee, aesthetic faults, paints, varnishes, appearing on blades, bodies, are not covered by the guarantee, articles without possibility of repair will always be replaced by the same article.

The return for guarantee does not cover transport costs in the return of the product as well as in subsequent shipment in the case of repair or change, always being the responsibility of the client, not admitting any product that does not come in these conditions.

WARRANTY AND RETURNS

I) Conformity of the products with the contract

Unless proven otherwise, it will be understood that the products are in accordance with the contract provided that they meet all the requirements that are expressed:

a) Be suitable for the uses to which products of the same type are ordinarily intended.

b) NCH STOCK 23 S.L. describes the details, technical characteristics and photographs of the products provided by their manufacturer, so that it is not bound by these public statements.

II) Products replacement

The replacement requires that the USER gives notice to the PROVIDER by email at his address info@ncharchery.com attaching the proof of invoice. After that the PROVIDER wil confirm if substitution is possible. The replacement item will be sent within 72 hours once it has been confirmed that such substitution is possible. In addition, the USER will send the PROVIDER a copy of the shipping note or carrier’s delivery number.

a) The transport costs in case of replacement will always be borne by the USER.

b) Once the replacement request sent by the USER has been received, and verified that the replacement or return conditions have been met, the PROVIDER will notify the USER of an approximate period for the delivery of their item.

c) If the product cannot be replaced due to manufacturing of that model, discontinuation, etc... the USER may request a refund of the money paid for it.

APPLICABLE LAW AND JURISDICTION

These conditions will be governed or interpreted in accordance with Spanish legislation in what is not expressly established.

The PROVIDER and the USER agree to submit any dispute that may arise from the provision of the products or services subject to these Conditions to the courts and tribunals of Zaragoza.
